Terms of Service

These Terms of Service (hereinafter: "Terms") govern the use of the booqd service (available at booqd.net, hereinafter: the "Service"). By using the Service, you agree to these Terms. Please read them carefully.
1. Description of the Service
booqd is a cloud-based (SaaS) booking and client management platform that provides the following features:
- Online booking management: managing and booking appointments for classes, training sessions, and consultations
- Schedule and calendar management: creating schedules, Google Calendar synchronization
- Membership and pass management: creating membership types, tracking validity, managing free sessions
- Member management: managing clients and guests within workspaces
- Payment processing: online payments via Stripe, instructor payouts (Stripe Connect)
- Notifications: email and push notifications for bookings, reminders, and cancellations
- Public booking page: a shareable link where clients can book directly
2. Eligibility
You must be at least 18 years old to use the Service, or use it under parental/guardian supervision. By registering, you represent that you are eligible to use the Service and accept these Terms.
3. Account Management
Registration is required to use the Service. You can register with an email address and password, or using your Google/Apple account.
Your responsibilities:
- Providing accurate and truthful information during registration
- Keeping your login credentials confidential
- Taking responsibility for all activities conducted through your account
- Promptly reporting any unauthorized use of your password to [email protected]
We reserve the right to suspend or delete accounts that contain false information or are used in violation of these Terms.
4. Subscriptions and Plans
The Service offers multiple subscription plans:
- Starter plan: available at no charge with essential features
- Growth and Scale plans: expanded capabilities with monthly or annual billing
- Custom plan: tailored setup and commercial terms based on business requirements
Subscription fees are payable in advance according to the chosen billing cycle (monthly or annual). Annual subscriptions offer a discounted rate.
Current pricing can be viewed in the Pricing section of the Service. Prices are listed in Hungarian Forints (HUF).
Subscriptions automatically renew at the end of each period unless cancelled beforehand. Upon cancellation, the subscription remains active until the end of the paid period.
5. Payment Terms
Payment processing is handled by Stripe, Inc. Credit card data is handled directly by Stripe in compliance with PCI DSS standards — this data is never stored on booqd servers.
Instructors receive payouts for bookings through the Stripe Connect system. The platform charges a service fee on transactions, the rate of which is visible in the instructor's workspace settings.
Refunds:
- Refund terms are determined by each workspace's cancellation policies, which are set by instructors
- The booqd platform fee is non-refundable
- Subscription fee refunds can be requested through the Stripe customer portal
6. Instructor Obligations
If you use the Service as an instructor, the following obligations apply:
- Maintaining accurate and up-to-date booking and schedule information
- Clearly communicating your cancellation policy to clients
- Complying with applicable tax and invoicing obligations — booqd does not constitute a tax advisor
- Properly setting up your Stripe Connect account to receive payouts
- Maintaining confidentiality of workspace member data
7. User Content
You retain ownership of content uploaded to the Service (profile pictures, class descriptions, messages, workspace data). booqd does not claim ownership over user content.
By uploading content, you warrant that the content does not infringe on third-party copyrights, does not contain illegal, harassing, or obscene material, and that you have the necessary rights to share it.
8. Acceptable Use
When using the Service, the following activities are prohibited:
- Abusing the Service or interfering with other users' access to the Service
- Creating or manipulating fraudulent bookings
- Harassing or threatening other users through the Service
- Uploading or distributing malicious code (viruses, malware)
- Circumventing or testing the Service's security measures without permission
- Using the Service with automated tools (bots, scrapers)
- Reselling the Service without written permission from booqd
9. Third-Party Services
The Service integrates third-party services (Stripe, Google, Apple). Use of these services is governed by their respective terms. booqd is not responsible for the operation, availability, or data handling practices of third-party services.
10. Intellectual Property
The Service (including software, design, logos, and documentation) is the intellectual property of booqd and is protected by copyright. Users receive a limited, non-exclusive, non-transferable license to use the Service under these Terms.
11. Limitation of Liability
The Service is provided "as is," with all warranties excluded to the fullest extent permitted by law.
booqd is not liable for:
- Data loss caused by user actions
- Damages resulting from temporary unavailability of the Service
- Lost profits or indirect damages
- Damages arising from failures of third-party services (Stripe, Google, Apple)
- Disputes between instructors and their clients
In all cases, booqd's liability is limited to the subscription fees paid by you in the preceding 12 months.
12. Termination and Account Deletion
You may initiate account deletion at any time through your profile settings or by contacting [email protected]. Upon account deletion:
- Your personal data will be deactivated
- Your active subscription remains valid until the end of the paid period
- Data required by law (payment records) will be retained for the mandatory retention period
We reserve the right to immediately suspend or terminate access for accounts that violate these Terms, particularly the acceptable use provisions.
13. Changes to Terms
We reserve the right to modify these Terms. We will notify users of significant changes via email at least 30 days before they take effect. Continued use of the Service constitutes acceptance of the modified Terms. If you do not agree with the changes, you may delete your account.
14. Governing Law and Disputes
These Terms are governed by Hungarian law. The parties shall primarily seek to resolve disputes related to the Service amicably. If unsuccessful, Hungarian courts shall have jurisdiction over such disputes.
